Harper/Reynolds Get Ok To Head To Supreme Court

The Attorneys for Richard Scott Harper and Michelle Reynolds have filed a petition for immediate review of Judge J Bryant Durham’s Order denying their motion to dismiss the indictment against Reynolds and Harper.

The Rome News-Tribune is reporting Harper and Reynolds’ attorneys have submitted the indictment to the Supreme Court for review. However, Harper’s Attorney Chris Twyman says they have not submitted anything to the Supreme Court; because they are still working on the application.

That application, once submitted, asks the Supreme Court for the immediate review of Durham’s Order denying their motion to dismiss the indictment. If the review is granted by the Georgia Supreme Court, they will then proceed with the appeal on that one particular issue.

The law requires the attorneys to file the petition within 10 days of the judge’s order with the Superior Court Judge here. Judge Durham has signed the certificate of review which allows the attorneys to proceed to the Supreme Court.

Harper and Reynolds are charged in the July 5, 2004, stabbing death of Reynolds’ husband, Thad.

The attorneys are attempting to get the indictment against the two thrown out because attorneys say, the wrong person served on the Grand Jury in place of his son who was supposed to serve.
