Floyd County Middle School Student Accused of Assaulting Teacher

(Courtesy Fox 5) A middle school student in Lindale is accused of assaulting his teacher.
But the boy’s mother says he’s the victim.
School officials aren’t talking about the case, but the student’s mother said she’s reviewed a videotape of the incident and believes it clearly proves the teacher was out of line.
Eighth-grade student Cody Newberry has been suspended from school since a September 2 confrontation with a teacher at Pepperell Middle School in Floyd County.
“I never touched him,” said student Cody Newberry.
“They’re trying to charge him with simple battery saying he was provoking it — chest butting the teacher. That never happened,” said Cody’s mother Deborah Newberry.
District officials won’t comment about the incident, citing policy. In copies of school documents the Newsberrys received, administrators accuse the boy of hitting the teacher — an incident that was allegedly caught on tape.
The 14-year-old’s mother said she viewed the video and it clearly shows her son did nothing wrong.
“If anything it shows the teacher getting in my son’s face hollering at him,” said Deborah Newberry.
The Newberrys feel the teacher was the aggressor and are pursuing charges against him.
“Yes, this morning I took out a warrant for his arrest,” said Deborah Newberry.
School officials are recommending Cody Newberry be transferred to alternative school following his suspension.
His parents are fighting that move and say they plan to hire an attorney.
